1. Acceptance of Terms

These Terms and Conditions (the "Terms") govern your access to and use of the Snapbit mobile application and the website available at snapbit.ai (collectively, the "Service"), provided by Marko Mil (the "Provider").

By creating an account, joining the waitlist or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by the Privacy Policy. If you do not agree, please do not use the Service.

The Service is not intended for children under the age of 13. Users between 13 and 17 may use the Service only with the consent of a parent or legal guardian.

2. Description of Service

Snapbit turns what you are curious about into a personal podcast ("Snap"). You can generate Snaps by typing a topic, sharing an idea, pasting a link, uploading a file (such as a PDF or notes), or sharing a photo or screenshot. Each Snap is generated on demand using artificial intelligence and is automatically fact-checked before it is added to your library.

You can customize each Snap by choosing the narrator voice, the length (Quick: 5–9 minutes, Standard: 10–14 minutes, Deep: 15–20 minutes), the pacing and the language. Snaps can be downloaded and listened to offline.

The Service is offered through a free tier with limited functionality and a paid tier accessible via subscription or by purchasing minute packs ("top-up"). The Service is currently in pre-release; features, pricing and availability may change before and after the public launch on the App Store and Google Play.

3. User Accounts

To use the Service you must create an account by signing in with Google Sign-In or Sign in with Apple. Authentication is handled by Firebase Authentication (Google Ireland Ltd.), as further described in the Privacy Policy.

You are responsible for maintaining the confidentiality of the credentials associated with your account and for all activities that take place under it. You agree to provide accurate information and to notify us promptly at support@snapbit.ai of any unauthorized use of your account.

Each user may hold a single account. You may delete your account at any time from the Settings section of the App.

4. Intellectual Property

The Service, including the Snapbit name and logo, the App, the website, the underlying software, the user interface, the graphic design and all related materials, is the exclusive property of the Provider and is protected by Italian, European and international intellectual property laws.

Subject to your compliance with these Terms, the Provider grants you a personal, limited, non-exclusive, non-transferable and revocable licence to access and use the Service for your personal, non-commercial use. No other right or licence is granted, expressly or by implication.

5. User Content

"User Content" means any text, link, file, image, photo, screenshot or other material you provide to the Service to generate a Snap. You retain all rights you already hold in your User Content.

By submitting User Content, you represent and warrant that (i) you own such content or have all the rights, licences and permissions necessary to submit it, and (ii) the content does not infringe any third-party right (including copyright, trademark, privacy or publicity rights) and does not violate any applicable law.

You grant the Provider a limited, worldwide, royalty-free licence to host, process and transform your User Content for the sole purpose of generating, delivering and storing the Snaps you request. As described in the Privacy Policy, images uploaded to generate a Snap are deleted after processing and are not used to train AI models.

You are solely responsible for your User Content and for the consequences of submitting it.

6. Prohibited Uses

When using the Service you agree not to:

• upload or generate content that is illegal, defamatory, obscene, hateful, threatening, or that infringes the intellectual property, privacy or other rights of any third party;
• use the Service to create content that exploits or harms minors;
• attempt to reverse engineer, decompile, disassemble or otherwise derive the source code, prompts or AI models behind the Service, except to the extent permitted by mandatory law;
• use bots, scrapers or other automated means to access the Service, or interfere with its normal operation;
• resell, sublicense or otherwise commercially exploit the Service or the Snaps generated through it without our prior written consent;
• circumvent any usage limits, paywalls or technical protection measures, including subscription or top-up limits;
• use the Service in violation of any applicable law or regulation.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

7. Limitation of Liability

Snaps are generated automatically by artificial intelligence models. Although every Snap is automatically fact-checked, the Service may produce inaccurate, incomplete or out-of-date information. Snaps are provided for informational and entertainment purposes only and do not constitute professional advice (medical, legal, financial or otherwise). You should independently verify any information before relying on it.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.

Within the limits permitted by Italian and EU consumer protection law, the Provider shall not be liable for indirect, incidental, special or consequential damages, nor for loss of data, profits or opportunities, arising out of or in connection with your use of the Service. Nothing in these Terms limits any liability that cannot be excluded by law, including liability for fraud, gross negligence or harm to consumers' fundamental rights.

8. Termination

You may stop using the Service and delete your account at any time from the Settings section of the App. Upon deletion, your data is handled as described in the Privacy Policy.

The Provider may suspend or terminate your access to the Service, in whole or in part, with or without notice, if you breach these Terms, if it is required to do so by law, or if it discontinues the Service. Where reasonably possible, we will give you advance notice and the opportunity to export your data.

Sections that by their nature should survive termination (including those on Intellectual Property, User Content, Limitation of Liability and Governing Law) will continue to apply after termination.

9. Changes to Terms

We may update these Terms from time to time to reflect changes to the Service, our business or applicable law. The updated version will always be available at this URL with the "Last updated" date shown clearly at the top of the page.

In case of substantial changes, we will notify you in advance through the App or by email. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes. If you do not agree, you may stop using the Service and delete your account.
